At first Mikael Badalyan was charged under Article 259 of RA Criminal Code, passed on April 18, 2003 (giving false information about terrorism under preparation). However, as we know, the said law is considered to be invalid, and simple logic and legal common sense suggest that the alleged act committed by Mikayel Badalyan should be compared with the RA Criminal Code, which entered into force in July 2022, since no law enforcer, including the court, can rely on the invalid law, since that law has actually ceased to exist.

Understanding that, the investigative body submitted a petition to the supervising prosecutor on 08.07.2022 to initiate a public criminal prosecution against Mikayel Badalyan under Article 314 Part 23 of the RA Criminal Code, which came into force on 01.07.2022. On 08.07.2022 the prosecutor rejected the motion of the investigator on the grounds that the 2nd part of the article 314 part 2 of the Criminal Code in force worsens the condition of Mikayel Badalyan.

Thereafter, instead of terminating the criminal case, the investigator left Mikayel Badalyan charged under the repealed law and filed a petition with the court to extend his detention for another month.

The actions of the investigator are illegal and Mikael Badalyan should be released from custody for several reasons: Mikayel Badalyan is currently being charged under a law that has actually expired. A person in the sphere of criminal-legal relations must know which article qualifies the act he committed in order to be able to at least electronically open and read it. In other words, at least when considering the request for extension of his detention until 18.07.2022, Mikayel Badalyan has the right to know under which law and under which article his actions are qualified, and to ask the state to clarify the charges brought against him. It should be admitted that in this case there has been a change in the law, which has increased the punishment for this act. That is why the prosecutor rejected the investigator's motion to bring Mikayel Badalyan's alleged act into conformity with the new Criminal Code. Thus, it is obvious that the said amendment has no retroactive force and cannot be applied in qualifying the alleged criminal act of Mikayel Badalyan until the amendments to the law are made.
During the preceding period of Mikael Badalyan's detention the investigator did not show due diligence in ensuring the investigative action on the case (and this is an important condition for the detention of a person in custody). The term of Mikael Badalyan's detention has been extended until June 17, 2022. Then the court gave the investigator a month to carry out allegedly large-scale activities, but it turned out that the investigator within a month only applied to the prosecutor's office to bring Mikayel Badalyan's charges in line with the new law, but it was rejected. That is, it is obvious that from the very beginning the prolongation of Mikayel Badalyan's custody was an end in itself. And now the investigator is again asking the court to allow him to perform the specified and unimplemented judicial actions at the expense of Mikayel Badalyan's freedom, which, to put it mildly, is unacceptable.

Understanding that, the investigative body submitted a petition to the supervising prosecutor on 08.07.2022 to initiate a public criminal prosecution against Mikayel Badalyan under Article 314 Part 23 of the RA Criminal Code, which came into force on 01.07.2022. On 08.07.2022 the prosecutor rejected the motion of the investigator on the grounds that the 2nd part of the article 314 part 2 of the Criminal Code in force worsens the condition of Mikayel Badalyan.

Thereafter, instead of terminating the criminal case, the investigator left Mikayel Badalyan charged under the repealed law and filed a petition with the court to extend his detention for another month.

The actions of the investigator are illegal and Mikael Badalyan should be released from custody for several reasons: Mikayel Badalyan is currently being charged under a law that has actually expired. A person in the sphere of criminal-legal relations must know which article qualifies the act he committed in order to be able to at least electronically open and read it. In other words, at least when considering the request for extension of his detention until 18.07.2022, Mikayel Badalyan has the right to know under which law and under which article his actions are qualified, and to ask the state to clarify the charges brought against him. It should be admitted that in this case there has been a change in the law, which has increased the punishment for this act. The term of Mikael Badalyan's detention has been extended until June 17, 2022. In this connection there will be a need to organize jobs in the planned "new federal districts.
The situation in single-industry towns with one or more major manufacturing enterprises, where de facto unemployment is already observed due to the shutdown of production facilities, is seen as problematic, albeit with 2/3 of wages still intact. It is symptomatic that these are not only "foreign" productions, but also those that used imported components.

It is likely that the main increase in recorded unemployment will be among the able-bodied population who have recently obtained citizenship. In this connection there will be a need to organize jobs in the planned "new federal districts.
The situation in single-industry towns with one or more major manufacturing enterprises, where de facto unemployment is already observed due to the shutdown of production facilities, is seen as problematic, albeit with 2/3 of wages still intact. It is symptomatic that these are not only "foreign" productions, but also those that used imported components.
